    Driving with suspended driver's license

    Hi,

    I live in PA (not sure if that helps) and I know of a person driving with a suspended driver's license.  He brags about not having his license but being able to buy a car and drive around at his leisure.  He drives everywhere, to and from work, etc.  I do know his driving record includes at least one incident of him being pulled over with the suspended driver's license.  Now, we have a daughter together, and I refuse to let her ride with him because that would be irresponsible on my behalf.  Police, am I making a big deal about this?  I personally don't think so.  Let's say he is driving, with our child in the vehicle and he gets pulled over again, what will happen?  Thanks in advance for responding.

    i'm pretty sure you get arrested and taken to jail for driving without a license, or on a suspended license.

    why don't you get him into the dmv so he can have some stuff taken care of, i'm sure he can apply for a permit or something.  talk him out of driving though cuz he if gets caught it's probably a long time before he'll be able to legally drive again

    Dont know about your state, but in CA if you get pulled over with a suspended license you automatically get arrested, your car is impounded on the spot, and you get a huge fine.  Depending on your previous convictions you will get a jail sentence of variable length (up to 30 days I think).  What will happen to your daughter?  1.  If the cop is really touched by her big innocent eyes he might let both of them go.  2.  They arrest him, impound the car, and call you to pick her up on that spot.  3.  Same as #2 only your daughter gets to spend a day in police custody untill they arrange with you to pick her up from social services.

    This happens a lot actually.  If it was me, your husband will be asked to step out of the car and will be placed in handcuffs in front of your child..then I will have to go into the car pull out your already tramatized child and take them in a police car to the precinct until someone responsible enough to supervise them can pick them up.  If no one is available then I would be forced to call Children Services to come and pick them up to be placed in their care. Then I will look to stack any and all charges I can, inculding child endangerment on your ex for causing that scene.  Then I will make more calls to child services to ensure a case file is created against your ex, child services will then be in touch and will do an investigation of thier own to see if this is an isolated incident or part of a pattern of neglegence.

    In CA (and presumably all states) you have to be physically served with the notice of suspension before you can be charged with driving on a suspended license.

    Not sure what state you're in, but here in NY City, it's an automatic arrest, and because most suspensions are for failure to answer a summons (ticket) or failuret to pay a fine, you get the whole package, a trip to central booking and a night in jail before you see the judge in the morning.  No appearance ticket or stationhouse bail as some places have, since you've already proved your inability to be responsible.  And the previos post by PoPo was dead on about how it would go for your daughter...

    I got pulled over on a suspended. They wrote me up for it and told me to park my car and call someone to pick me up, but they implied to wait until they drive away and then drive directly home.

    This was in NJ. I think I just got pulled over by decent guys though, it's definitely a serious offense.

    No you are not making a big deal about it.

    How I usually handle it is if it's the first time you got caught, you get a ticket and get to drive home. If I catch you and you have been cited before, you get cited again (Misdemeanor this time) and your can gets impounded ($60 tow and $12 a day impound fee). If I see you have a history of DWLS you go to jail and your car gets impounded.

    If you have your minor children in the car then CPS gets to place the children in foster care.

    Driving while suspended can also lead to a felony arrest. All it takes is for you to be involved in a no-fault accident and SOMEONE be injured (even a bump on the arm).

    Of course all of this is based on Indiana State Law. Your situation may vary.

    I got pulled over in AZ 15 years ago on a suspended license.  They gave me a ton of tickets and told me they were towing my car.  I refused and told them I would have it towed myself.  I faked a cell phone call to the "tow company" and played the waiting game with them.  As soon as they left, I drove home.  I was young and dumb then.  I know they could have definitely taken me to jail, but they didn't.  Would I let my significant other drive around with my children and no license?  Hell no.  Eventually it will catch up to him.  I even moved around 2300 miles and 10 year later they caught up to me!
